These Terms of Service and Privacy Policy ("Terms") govern your access to and use of the Pluri mobile application and related services (together, "Pluri"). Pluri is provided by Vasyl Krychun, an individual entrepreneur established in Ukraine ("we", "us", "our"). By tapping Start with one thing, by signing in, or by otherwise accessing or using Pluri, you ("you" or "the user") confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use Pluri.
1. Definitions
1.1 "Pluri" means the Pluri mobile application, its content, and the related online services we operate.
1.2 "Prompt" means the text you enter into Pluri to request the generation of a Tool.
1.3 "Tool" means the output generated by Pluri from your Prompt, expressed as a StemJSON module, together with any module you build, edit, or share through Pluri.
1.4 "StemJSON" means the declarative JSON format in which Tools are expressed.
1.5 "Stems" means the prepaid usage allowance used to meter the generation of Tools, as described in Section 5.
1.6 "Model Provider" means the third-party artificial-intelligence provider that processes your Prompt to generate a Tool, as described in Section 7.
2. Eligibility and accounts
2.1 Pluri may be used either without an account or with an account created through Apple or Google sign-in.
2.2 If you are under the age of 16, you may use Pluri only with the consent and supervision of a parent or legal guardian, who must read and accept these Terms on your behalf. We do not knowingly collect personal data from children under 16 without such consent.
2.3 You are responsible for maintaining the confidentiality of any account used to access Pluri and for all activity that occurs under it.
3. Licence to use Pluri
3.1 Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use Pluri for your personal or internal business purposes on Apple-branded devices that Pluri supports and that you own or control, in accordance with the Usage Rules of the Apple Media Services Terms and Conditions.
3.2 You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of Pluri, except to the extent this restriction is prohibited by applicable law.
3.3 All rights not expressly granted to you are reserved by us and our licensors.
4. Tools generated by AI
4.1 Tools are generated automatically by an artificial-intelligence Model Provider from your Prompt. Generation is probabilistic: the same Prompt may produce different results, not every request can be fulfilled, and a Tool may be inaccurate, incomplete, non-functional, or otherwise unsuitable for your purpose.
4.2 You are solely responsible for reviewing and testing each Tool before relying on it. You must not rely on a Tool for any purpose where an error could lead to loss, injury, or other harm.
4.3 Because every Tool is expressed as StemJSON, you may refine your Prompt and generate again, or, if you have the necessary technical knowledge, edit the StemJSON directly to obtain the result you want.
4.4 As between you and us, you own the Tools you generate, subject to the rights of the Model Provider in the underlying model and to any third-party rights. You are responsible for ensuring that your use of a Tool, and any data you enter into a Tool, complies with applicable law and does not infringe the rights of others.
5. Stems, purchases, and refunds
5.1 Stems are a prepaid usage allowance used to meter the generation of Tools. Stems have no monetary value, are not money or a payment instrument, and cannot be exchanged, transferred, or redeemed for cash.
5.2 We provide a free allowance of Stems, drawn from a shared monthly pool available to all users on the free tier. When that pool is exhausted, free generation is suspended until the pool refills at the start of the following month. Purchased Stems and generation using your own Model Provider key are not affected by the pool.
5.3 Stems may also be purchased as one-time in-app purchases. All purchases are processed by Apple through the App Store; we do not receive or store your payment details.
5.4 The size of the free allowance and of purchasable Stem packs may change as the cost of the underlying models changes. Stems you have already purchased remain valid.
5.5 Refunds for purchases are handled by Apple in accordance with its policies. Refund requests must be submitted to Apple at reportaproblem.apple.com. We do not separately refund Stems.
6. Acceptable use
6.1 You agree to use Pluri only for lawful purposes and in accordance with these Terms. You must not:
(a) use Pluri to create, store, or share any content that is unlawful, harmful, defamatory, obscene, or that infringes the intellectual property, privacy, or other rights of any person;
(b) use Pluri to generate or facilitate malware, fraud, harassment, or any other activity prohibited by law;
(c) attempt to gain unauthorised access to, interfere with, disrupt, or overload Pluri or its supporting infrastructure;
(d) circumvent, disable, or attempt to exceed the Stem metering or any other usage limit or security measure; or
(e) use Pluri in breach of the terms of any Model Provider or other third-party service.
6.2 We may investigate suspected breaches of this Section and may suspend or terminate your access to Pluri, with or without notice, where we reasonably believe a breach has occurred. You remain responsible for the Tools you create and for your use of them.
6.3 Shared content. We have no tolerance for objectionable content in Tools shared through Pluri. You can report a shared Tool from within the app (see Section 9.6), and we may remove shared content and restrict sharing for anyone who breaches this Section.
7. Third-party services
7.1 Model Providers. To generate a Tool, your Prompt is transmitted to a Model Provider:
(a) on the free tier, to OpenAI, L.L.C. in the United States; or
(b) where you configure your own API key, to the Model Provider you select, under your own account and subject to that provider's terms.
7.2 Hosting. Prompts, generated responses, and feedback are stored on infrastructure operated by Google (Firebase).
7.3 Payments and sign-in. Purchases are processed by Apple; sign-in is provided by Apple or Google. Your use of those services is subject to their respective terms and privacy policies.
7.4 We are not responsible for the acts, omissions, content, or terms of any third party, and your dealings with them are at your own risk.
8. Privacy and data protection
8.1 Controller. The controller of your personal data is Vasyl Krychun, contactable at vkrychun@stemjson.com.
8.2 Data we process. We process: (a) the Prompts you enter; (b) the responses generated from them; (c) any feedback you provide on a Tool; (d) a random application identifier generated on first launch, used to meter your free allowance; (e) your account identifier from Apple or Google, if you sign in; (f) records of your Stem usage and purchases; and (g) if you publish a Tool, the Tool's content and a generated preview image, which we host so the Tool can be shared by link. We do not receive your payment-card details.
8.3 Data minimisation. The Prompt is the only free-text field you enter. You must not include personal or sensitive information (such as names, contact details, or health data) in a Prompt, because it will be stored together with the Prompt. Data you enter into a Tool you build is stored by that Tool, on your device or on a backend you configure, and is not collected by or accessible to us.
8.4 Purposes and legal bases. We process your data to: provide and operate Pluri and generate Tools (performance of a contract, Article 6(1)(b) GDPR); meter your allowance and process purchases (performance of a contract); maintain, secure, and improve the quality of Pluri and prevent abuse (our legitimate interests, Article 6(1)(f) GDPR); and, where required, on the basis of your consent (Article 6(1)(a) GDPR), which you may withdraw at any time.
8.5 International transfers. Where your Prompt is processed by OpenAI in the United States, the transfer is made under the European Commission's Standard Contractual Clauses. Transfers to any other Model Provider you select are governed by your arrangement with that provider.
8.6 Retention. We retain your data for up to 24 months, after which it is deleted or anonymised. You may request earlier deletion: if you are signed in, delete your account in Settings; otherwise, email vkrychun@stemjson.com. We complete deletion within 30 days. Tools you publish, and their preview images, are retained until you stop sharing them or we remove them; deleting your account de-identifies them but does not retract links you have already published (see Section 9.7).
8.7 Your rights. Subject to applicable law, you have the right to access, rectify, erase, restrict, and port your personal data, to object to its processing, and to withdraw consent at any time. Deleting your account removes your account and the data linked to it and de-identifies your past Prompts, responses, and feedback, which we retain in de-identified form to improve Pluri. To exercise any right, or to request full erasure, email vkrychun@stemjson.com. You also have the right to lodge a complaint with your local data protection supervisory authority.
9. Sharing Tools
9.1 Tools stay on your device unless you choose to share them. Pluri offers two ways to share:
(a) As a file. You can export a Tool as a .stem file and send it to someone directly. The recipient accepts it at their own risk.
(b) As a link. You can publish a Tool to get a public link (a stemjson.com address) and a preview image. When you publish, the Tool's content and a generated preview image are uploaded to and hosted on our infrastructure so that anyone with the link can view a preview and import the Tool. A published Tool is public: the link is unguessable but not secret, and we do not control how far it is shared.
9.2 Licence to host. When you publish a Tool, you grant us a worldwide, non-exclusive, royalty-free licence to store, reproduce, display, and distribute that Tool and its preview image for the purpose of operating the sharing feature. This licence lasts until the Tool is unpublished or removed.
9.3 Your responsibility. You represent and warrant that any Tool you share is yours, does not violate any law, and does not infringe the rights of any third party. You are solely responsible for any Tool you share and for the consequences of sharing it.
9.4 Stopping a share. You can stop sharing a published Tool at any time from within Pluri. This disables the link so the Tool can no longer be viewed or imported through it. People who already imported the Tool keep their own copy; unpublishing does not reach those copies.
9.5 Imported Tools. Tools you import from a link or file are created by other people, not by us. We do not create, endorse, or vet them, and the automated safety check offered before you open an imported Tool is not a guarantee. You import and use them at your own risk.
9.6 Reporting and removal. If a Tool shared with you is objectionable, you can report it from within Pluri. We may, at our discretion and without notice, disable or remove any shared Tool - including automatically once a Tool reaches a threshold of reports - and may suspend the ability to share for anyone who abuses the feature.
9.7 Account deletion and shared Tools. Links you have already published remain available after you delete your account, because other people may rely on them, but they are de-identified and no longer linked to you. You can disable any of your published links before deleting your account by stopping the share.
10. Intellectual property
10.1 Pluri, including its software, design, and the StemJSON specification and runtime, together with all related intellectual property, is owned by us and our licensors and is protected by law.
10.2 These Terms grant you no right in our trademarks, logos, or branding.
11. Disclaimer of warranties
11.1 To the maximum extent permitted by applicable law, Pluri and all Tools are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
11.2 We do not warrant that Pluri will be uninterrupted, error-free, or secure, or that any Tool will meet your requirements. Nothing in this Section excludes any warranty or guarantee that cannot be excluded under applicable law, including mandatory consumer guarantees.
12. Limitation of liability
12.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection law.
12.2 Subject to Section 12.1, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of Pluri or any Tool.
12.3 Subject to Section 12.1, our total aggregate liability arising out of or in connection with these Terms and your use of Pluri is limited to the greater of (a) the total amount you paid to us for Pluri in the 12 months preceding the event giving rise to the liability, or (b) where you are a consumer, any higher amount that mandatory law requires.
13. Indemnification
To the extent permitted by applicable law, and except where you are a consumer and applicable law provides otherwise, you agree to indemnify and hold us harmless from any claim, liability, or expense arising out of your breach of these Terms, your misuse of Pluri, or any Tool you create or share.
14. Apple and App Store terms
This Section applies where you obtain Pluri through the Apple App Store. It is required by Apple and, with respect to the matters it addresses, prevails over any conflicting provision of these Terms.
14.1 Acknowledgement. You and Vasyl Krychun acknowledge that these Terms are concluded between you and Vasyl Krychun only, and not with Apple, and that Vasyl Krychun, not Apple, is solely responsible for Pluri and its content.
14.2 Scope of Licence. The licence granted to you for Pluri is limited to a non-transferable licence to use Pluri on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
14.3 Maintenance and Support. Vasyl Krychun is solely responsible for providing any maintenance and support services with respect to Pluri. You and Vasyl Krychun acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Pluri.
14.4 Warranty. Vasyl Krychun is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Pluri to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Pluri to you; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Pluri, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Vasyl Krychun.
14.5 Product Claims. You and Vasyl Krychun acknowledge that Vasyl Krychun, not Apple, is responsible for addressing any claims of you or any third party relating to Pluri or your possession and/or use of Pluri, including, but not limited to: (a) product liability claims; (b) any claim that Pluri fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
14.6 Intellectual Property Rights. In the event of any third-party claim that Pluri or your possession and use of Pluri infringes that third party's intellectual property rights, Vasyl Krychun, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
14.7 Legal Compliance. You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
14.8 Developer Contact. Any questions, complaints, or claims with respect to Pluri should be directed to Vasyl Krychun at vkrychun@stemjson.com.
14.9 Third-Party Terms. You must comply with any applicable third-party terms of agreement when using Pluri.
14.10 Third-Party Beneficiary. You and Vasyl Krychun acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
15. Term and termination
15.1 These Terms apply for as long as you use Pluri.
15.2 You may stop using Pluri at any time and may delete your data as described in Section 8.
15.3 We may suspend or terminate your access as described in Section 6, or where required by law. Provisions that by their nature should survive termination (including Sections 4.4, 8, 10, 11, 12, 13, and 16) survive.
16. Governing law and jurisdiction
16.1 These Terms are governed by the laws of Ukraine, where Vasyl Krychun is established, without regard to its conflict-of-laws rules.
16.2 If you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom, you retain the protection of the mandatory provisions of the law of your country of residence; nothing in these Terms deprives you of that protection, and you may bring proceedings in the courts of your country of residence.
16.3 Subject to Section 16.2, the courts of Ukraine have jurisdiction over any dispute arising out of or in connection with these Terms.
17. Changes to these Terms
We may update these Terms from time to time. If a change materially affects you, we will present the updated version the next time you open Pluri and ask you to accept it. Your continued use of Pluri after a change takes effect constitutes acceptance, except where your express acceptance is required.
18. Severability, waiver, and entire agreement
18.1 If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
18.2 Our failure to enforce any provision is not a waiver of that provision.
18.3 These Terms constitute the entire agreement between you and us regarding Pluri and supersede any prior agreement on that subject.
